TRIBUNAL FEES

What are our fees if you are bringing or defending a claim for unfair dismissal and or wrongful dismissal?

The following fees structure includes preparation of your case up to and including a final hearing:

Simple case:  £3,000+VAT to £6,000+VAT

Medium complexity case:  £6,000+VAT to £10,000+VAT

High complexity case:  £10,000+VAT to £20,000+VAT

Our fees are often considerably less than these estimates if you ask us to seek early settlement of your claim.

Why are some cases more complex?

The following factors can make your claim more complex:

  • A case involving discrimination
  • A case involving whistleblowing
  • A case requiring expert evidence (for example, a case involving personal injury)
  • Whether the case is listed for a preliminary hearing, and if so, the length of that hearing and whether it is listed on the telephone or in person
  • Whether preliminary issues such as employment status or disability need to be argued
  • The number of witnesses needed to support your claim
  • The volume of documentation provided by you and your opponent
  • The number of meetings (by phone and or in person) that take place
  • The need for interim applications such as disclosure requests
  • Whether a remedy (compensation) hearing is listed separately from the final hearing
  • Whether there are any postponements
  • Costs applications

What do our fees cover?

  • Taking your instructions
  • Reviewing documents and bundles
  • Advising you on the strength of your claim
  • Drafting an ET1 or ET3, schedule of loss, agenda and list of issues
  • If appropriate, negotiating early settlement
  • Drafting and exchanging witness statements
  • Instructing counsel
  • Final preparations for the hearing(s)

Are there additional costs?

  • We instruct a barrister to represent you at a tribunal hearing because it is generally more cost effective. We have established strong relationships with barristers over the years and can advise you on which barrister would suit your circumstances.  The barristers fee will be between £750+VAT to £3,000+VAT per day, depending on the experience of the barrister and the complexity of the case.
  • The cost of a conference call or meeting with your barrister. We can negotiate a fixed fee in these circumstances.
  • Any experts fees incurred (for example, to establish personal injury, disability or actuarial advice).

How long will your case take?

If a settlement is agreed before your case is submitted, it is likely to take in the region of 6 weeks.  If your claim proceeds to a final hearing, it can take between 4 and 12 months to conclude.

Who will deal with your case?

Your case will be handled by Robert Weston who is an employment solicitor with extensive experience of acting for both individuals and businesses in tribunal claims.  Robert qualified as a solicitor in 2009 and is a Partner.

How are our fees calculated?

Robert’s hourly rate is £215+VAT per hour but is willing to discuss fixed fees where appropriate.
